Terms of Service for Event Organisers
Introduction
Undiscovered (ABN 49 485 302 916) ("Undiscovered AU") is an event ticketing platform. These Terms of Service ("Terms") govern your use of the Undiscovered platform as an event organiser. By using our platform, you agree to these Terms. If you do not agree to these Terms, do not use the Undiscovered platform.
Variation to Terms of Service
Undiscovered may vary these Terms of Service at any time by updating them. Any variations will only apply to events made after these Terms of Service have been updated.
Account and Event Information
- Accuracy of Information
You are responsible for maintaining the accuracy of your account information and the information about your events. If you provide any false, inaccurate, or incomplete information, or if Undiscovered has reasonable grounds to suspect that such information is false, inaccurate, or incomplete, Undiscovered may terminate your account and refuse any and all current or future use of the Undiscovered platform. - Security of Account
You are responsible for maintaining the security of your account and the information about your events, and you are fully responsible for all activities that occur under your account. You agree to immediately notify Undiscovered of any unauthorised use of your account or any other breach of security.
Fees and Payment
- Fees for Organisers
At the organisers choice, Undiscovered charges a fee to either the ticket buyer or event organiser for ticket sales. The fee is a percentage of the ticket price, including any applicable taxes. The exact percentage will be disclosed to you before you list your event on our platform, Or to the ticket buyer at checkout. - Payment Processing
Undiscovered uses third-party payment processors to process ticket payments. By using our platform, you agree to the terms and conditions of the relevant payment processor. You are responsible for any fees charged by the payment processor due to customer disputes.
Use of Platform
- Compliance with Laws
You agree to use the Undiscovered platform in compliance with all applicable laws. You may not use the platform for any illegal or unauthorised purpose. - Proprietary Rights
The Undiscovered platform and all content and software associated with the platform are the proprietary property of Undiscovered and are protected by applicable intellectual property laws. You may not use, copy, modify, or distribute the platform or any associated content or software without the express written consent of Undiscovered.
Termination
- Termination by Undiscovered
Undiscovered may terminate your use of the platform at any time, for any reason, with or without notice. - Termination by Organiser
You may terminate your use of the platform at any time by discontinuing your use of the platform and deleting your account.
Disclaimer of Warranties
- No Warranties
The Undiscovered platform is provided on an "as is" and "as available" basis. Undiscovered makes no representations or warranties of any kind, express or implied, as to the operation of the platform or the information, content, materials, or products included on the platform.
Limitation of Liability
- No Liability
In no event will Undiscovered be liable for any damages of any kind arising from the use of the platform, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
Dispute Resolution
- Governing Law
These Terms shall be governed and construed in accordance with the laws of the state of New South Wales, Australia. - Arbitration
Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of Australian consumer law.
